Terms of Use

Welcome to Bueza Pets (“Company”, “we”, “us”, “our”). These Terms of Use (“Terms”) govern your access to and use of our website, mobile application, and related services (collectively, the “Platform”). By accessing, registering, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any other policies incorporated by reference.

If you do not agree, please discontinue use of this website. 

1. Eligibility & User Responsibility
2. 1. You must be 18 years or older and competent to contract under the Indian laws.
   2. Minors may use the Platform only under parental/guardian supervision, with the adult assuming responsibility for compliance.
   3. You agree to provide true, accurate, and complete information during registration and keep it updated.
   4. Use the Platform only for lawful purposes and in compliance with applicable animal welfare and e-commerce laws.
   5. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. Scope of Services
   The Platform enables:
4. 1. Listing and sale of third-party pet food and nutritional products.
   2. Facilitation of veterinary consultations, grooming, training, adoption, and other pet-related services.
   3. Content sharing features such as reviews, ratings, pet profiles, and user-submitted media.
   4. Any additional allied services introduced from time to time.
      
      We act as an intermediary for third-party sellers and service providers. We do not manufacture pet food/nutritional supplements, do not employ veterinarians or groomers directly, and are not responsible for their independent advice, conduct, or performance. We do not breed or sell live animals directly. Listings for pets are provided by third-party breeders or individuals, who are solely responsible for compliance with applicable laws.
      
      
5. Orders, Pricing & Payments
6. 1. All orders placed are offers to purchase, subject to acceptance and availability. Order confirmation via email or Platform notification constitutes our acceptance with the conditions mentioned.
   2. Prices, product descriptions, discounts, and offers are subject to change without notice.
   3. We reserve the right to refuse, cancel, or limit any order for reasons including regulatory restrictions, mispricing, stock unavailability, or suspected fraud.
   4. Payments are facilitated through RBI-authorized payment gateways; you agree to comply with applicable KYC and AML laws.
   5. By using this Platform, you consent to our collection and processing of personal data as described in our Privacy Policy. You also consent to our use of cookies and similar technologies.
   6. We do not store your complete financial/payment information (such as card details).
7. Product & Service Specific Disclaimers
8. 1. Pet Food & Medications: All products are sold as per manufacturer specifications. We do not guarantee efficacy, safety, or suitability for your pet. Consult a veterinarian before use.
   2. Veterinary Services: All consultations are provided by independent, licensed veterinarians. We only provide access and are not liable for diagnosis, treatment, or medical outcomes. Veterinary consultations provided via the Platform are advisory only and should not substitute emergency medical care. 
   3. Grooming Services: Grooming carries inherent risks; the Company will not be liable for allergic reactions, injuries, behavioral issues, or other outcomes. Service providers are responsible for safety protocols. You must disclose your pet’s health conditions in advance.
   4. No Warranties: Except as required by law, we make no representations, express or implied, regarding products, services, or content on the Platform.
   5. We reserve the right to modify, suspend, or discontinue services or parts of the Platform at any time without notice.
9. Order Acceptance
10. 1. All orders placed on the Platform are subject to review and acceptance. We reserve the right to refuse, cancel, or limit any order at our discretion, including due to unavailability, errors in pricing or description, or suspected fraudulent activity.
    2. We reserve the right to cancel an order/service at any time, with a full refund, in case of unavailability, regulatory restrictions, or other unavoidable circumstances.
11. User-Generated Content (UGC)
12. 1. By posting UGC, you grant us a worldwide, royalty-free, perpetual, transferable license to use, display, reproduce, and distribute such content.
    2. You represent and warrant that your UGC:
    3. 1. Does not infringe intellectual property or privacy rights.
       2. Is not defamatory, obscene, unlawful, or harmful.
       3. Does not include advertising, spam, or malware.
       4. We reserve the right to monitor, edit, or remove UGC at our discretion.
    4. If you believe any UGC violates your rights or these Terms, please contact us at info@bueza.in. We reserve the right (but not the obligation) to investigate and remove such content.
13. Prohibited Conduct
    You agree not to:
14. 1. Misrepresent your identity, pet ownership, or health history of pets.
    2. Circumvent, disable, or interfere with Platform security.
    3. Use the Platform for fraudulent, illegal, or exploitative purposes.
    4. Engage in the resale of products/services purchased through the Platform without authorization.
    5. Post misleading, false, or malicious content against breeders, vets, partners, or other users.
15. Third-Party Links, Sellers & Service Providers
16. 1. The Platform may include links to third-party websites, applications, or services. These are provided for convenience only. We do not control, endorse, or assume responsibility for such third-party content, services, or practices. Your use of third-party platforms is at your own risk and subject to their terms and policies.
17. Intellectual Property
18. 1. All content, logos, designs, software, and trademarks on the Platform are owned or licensed by us and protected under Indian intellectual property laws.
    2. You may use Platform content only for personal, non-commercial purposes.
    3. Unauthorized reproduction, distribution, or reverse engineering is strictly prohibited.
    4. User UGC doesn’t give you ownership/right to intellectual property of the platform.
19. Indemnification
    You agree to indemnify, defend, and hold harmless the Company, its affiliates, officers, employees, and partners from any claims, damages, liabilities, or expenses arising out of:

    2. Violation of these Terms or applicable laws.
    3. Infringement of third-party rights by your actions or UGC.
21. Limitation of Liability
    To the maximum extent permitted under law:
22. 1. The Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
    2. Our aggregate liability, if any, shall not exceed the amount paid by you for the transaction giving rise to the claim.
    3. We do not assume responsibility for actions, omissions, or representations of third-party sellers, vets, or groomers.
23. Disclaimer of Warranties

The Platform, products, and services are provided “as is” and “as available,” without any warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee uninterrupted, error-free, or secure access to the Platform or that products/services will meet your expectations.
25. Communication & Consent
26. 1. By using our Platform, you consent to receive communications (via email, SMS, phone calls, app notifications, etc.) related to your orders, services, or account. You may also receive promotional communications, which you can opt out of at any time. All electronic communications will have the same legal effect as written communications.
27. Termination & Suspension
    We may, at our sole discretion, suspend or terminate your account and restrict access if you:

    2. Provide false information or misuse services.
    3. Engage in conduct detrimental to the Platform, other users, or our partners.
       Termination does not waive any rights or remedies accrued to us before such termination.
29. Platform Availability & Technical Downtime
    We do not guarantee uninterrupted or error-free access to the Platform. Scheduled maintenance or technical issues may cause temporary disruptions. We are not liable for any inconvenience, data loss, or missed appointments resulting therefrom.
30. Governing Law & Dispute Resolution
31. 1. These Terms shall be governed by the laws of India.
    2. Courts at Bangalore shall have exclusive jurisdiction.
    3. Disputes may first be referred to arbitration under the Arbitration and Conciliation Act, 1996, with one sole arbitrator appointed by the Company.
32. Force Majeure
    We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, war, labor disputes, pandemics, internet outages, or government restrictions.
33. Amendments
    We may modify these Terms at any time. The updated Terms will be posted on this page with the “Last Updated” date. Your continued use of the Platform constitutes acceptance.
